The city recognizes that certain types of home based businesses may be carried on without an adverse impact on the residential property or surrounding neighborhood, but that limitations are necessary to preclude the business activities that are of a scale or type which may be incompatible in a residential context. A home occupation permit allows the applicant to conduct a business from the applicant's home; there is no cost for the permit. Three levels of home occupations exist: Level 1 - No Impact, Level 2 - Minor Impact, and Level 3 - Major Impact. Application for Home Occupation Permit
Level 1: No Impact
Level 1 home occupations do not require a permit. All Level 1 home occupations must be conducted entirely within the home. No outdoor storage, including within enclosed spaces such as garage or shed, of goods, materials, equipment, trailers, or products associated with the home occupation are allowed. No non-occupant employees or face-to-face customer or client interactions occur at the property. No signage or window displays are allowed. All deliveries to and from the property are limited to services provided by routine residential carriers.
Level 2: Minor Impact
Level 2 home occupations require submittal and approval of a Home Occupation Permit and $60 application fee. Level 2 home occupations are conducted entirely within the home or an approved accessory building. No storage of goods, materials, equipment, trailers, or products associated with the home occupation are allowed outdoors. Up to 1 non-occupant employee may work at the home. Employee parking must be provided on-site. Customer or client interactions within the home are limited to no more than 4 per hour between the hours of 8:00 a.m. and 8:00 p.m. Customer or client interactions occurring on site, but outside of the home, are limited to no more than 4 per hour between the hours of 8:00 a.m. to 5:00 p.m. Monday through Friday. All deliveries to and from the property are limited to services provided by routine residential carriers.
The following uses may be considered a Level 2 home occupation provided that there are no non-occupant employees:
- Pet sitting, grooming, or training. No overnight boarding, no outdoor kenneling, and no more animals on site than permitted by Clive Code Section 5-7-12 Number of Animals and Fowl Limited, which allows not more than 4 dogs or cats or combination thereof over the age of 6 months.
- Beauty parlors, barbershops, massage, and other similar personal care services.
- Daycare services, with hours of operation limited to 6:00 a.m. to 7:00 p.m. Monday through Friday.
Level 3: Major Impact
Level 3 home occupations do not fit into the restrictions described for a Level 1 or Level 2 home occupation. Level 3 home occupations require submittal and approval of a Special Use Permit and a $275 application fee. Approval of a Special Use Permit requires attendance at a Board of Adjustment meeting to answer questions from the board.
