NUISANCE ABATEMENT

Clive City Code-Section 50.02

The first step in nuisance abatement begins with an on-site inspection of reported violations followed by determining the legal ownership of the property involved.  In some cases photographs are taken by the inspector to verify violations.  A letter of notification with a request to mow is then prepared and mailed to the property owner.

Lots:                   Owners are notified by certified mail and given 7 days from the day the notice is mailed to comply.

Right of ways:    Owners are notified by regular mail and given 7 days from the day the notice is mailed to comply.

After the allotted time for compliance has expired, properties are once again inspected for violations.  Properties found not to be in compliance are noted and scheduled for mowing.  Owners whose properties are cut by City crews are billed for actual time spent correcting the violation at a rate of $150/hour (1 hour minimum)plus $36.00 Administrative Fee for lot mowing and $59.00/hour (1 hour minimum)Plus $36.00 Administrative Fee for right of way mowing.

The enforcement procedures allow for due process for the property owner, with time allowed for notification, appeal and remediation.  To contact the weed inspector call the Public Works Department at 515-223-6231.
